TERMS AND CONDITIONS OF SALE
Reference: Padman Civil Pty Ltd, trading as Padman Quick Culverts (PQC throughout this document).
Thank you for choosing PQC to help with your civil requirements. Your order is appreciated, and we look forward to working with you now and into the future.
General
1. The following terms and conditions in this quotation/order confirmation are for you the client to read and will help you understand your role in purchasing from PQC.
2. This quotation is valid for a period of 30 days from date of issue, unless otherwise noted.
3. All prices in Australian Dollars and all prices exclude GST.
4. If you wish to place an order based on a quotation provided, please either sign and return the quotation to PQC or reply to your sales contact. If a deposit is required, you will receive a pro forma invoice once the quote confirmation has been received by PQC. Once your order has been received and processed you will receive an order confirmation from PQC.
5. Quotation is for the entire supply of the goods. Once an order is placed and if any goods remain undelivered, PQC reserves the right to charge the remaining goods in full to the customer’s account.
6. Quantities quoted are approximate only and should be confirmed prior to placement of the order. PQC reserve the right to review prices, prior to confirmation of order, should quantities and/or specifications vary from those quoted.
7. Prices are quoted in sections unless otherwise noted.
Payment
8. All orders under the total amount of $10,000 will require 100% payment before being released to production.
9. All orders over $10,000 will require a 25% deposit before being released to production and the other 75% of balance paid on completion of production.
10. For all non-account customers, payment may be received prior to shipment of the goods.
11. All quotes are valid up to 30 days from receipt.
Quality
12. PQC are manufactured to AS1597 unless otherwise noted.
13. Other precast Concrete products are manufactured to AS3600 unless otherwise noted.
14. Applicable fill heights are for installed products only and do not allow for construction loadings. Consult PQC for fill details.
Exclusions
15. Prices do not include any other extra rubber seals, external bands, bituminous tape/primer (Denso tape or equivalent), mastic, corrosion inhibitor, protective coatings, grout or epoxy and/or assorted products unless otherwise noted.
16. No allowance has been made for splays, skews, starter bars, dowel pin/holes, unless otherwise noted.
17. No allowance has been made for inserts, except lifting anchors, unless otherwise noted.
Lead Times
18. Manufacturing lead-times are subject to availability at the time of order and must be confirmed at that time. Lead-times may be different to the ones stated at the time of the quotation.
19. PQC needs 72 hours’ notice to arrange delivery. If less than 72 hours’ notice is given PQC reserve the right to charge a delivery surcharge. Special goods may require more notice. Check with your salesperson.
Transport
20. PQC load vehicles from Monday – Friday 7am to 3pm, excluding public holidays. Deliveries outside these times must be agreed in writing and may incur additional charges.
21. Prices are subject to distance and tonnes to be delivered.
22. Delivery cost is subject to PQC policy which you received a link to on your quotation email.
23. Unloading: Transport will be on Truck delivered to the recipient’s site to be unloaded by our driver/ operator. If other parties are unloading, we will require notice, unless otherwise noted. It is imperative that the correct chains and lifting devices are used for the lifting connections in the products to ensure safety. PQC would be happy to place products at various sites at an extra cost of $115 plus GST per hour.
24. Wet weather, poor access, unreachable contact person or severe weather conditions may result in delivery cancellations. PQC reserve the right to charge transport and double handling fees if cancellations are made less than 24 hours before the goods were intended to be loaded.
Customer Pick Up
25. Prior to arriving at the PQC yard to pick up your order, please review the order details to ensure they are correct. Your estimated completion date is only a guide for you and can vary up to five days either side of this.
· Pick-ups must be collected within 14 days of notification of the order being ready for collection.
· Orders will be invoiced upon completion of production.
· Customers who DON’T pick up within this period may be charged with a Storage and Handling fee unless prior arrangements are made. (See below)
· Our OH&S Policy requires all customers picking up goods to wear Hi-Vis clothing, streel cap boots and stay within the loading bay area, otherwise collection may be refused. Children under the age of 16 must always remain in the vehicle.
· The Padman Group forklift operator always has ultimate authority of the loading bay.
· All people attending site to pick up an order must complete a site induction prior to entering the site. If you haven’t received a link, please get in touch prior to arriving.
Storage and Handling
26. A yard handling fee applies for all pick-ups. This fee is $250 per truck and $150 per ute or trailer. This will appear on your invoice. If you wish to change your order to a delivery, please get in touch with us ASAP.
27. Padman Quick Culverts reserves the right to charge Storage and Handling Fees of 10% of the invoice value of the goods per week per product for goods that remain undelivered 30 days after the agreed delivery date.
Warranty
28. Concrete Products.
Period of Warranty is 24 months from the date of delivery and includes parts and workmanship.
Warranty exclusions
· Damage by owner or contractor
· Damage during transport if not delivered by PQC.
· Fire Damage
· Anything that is attached to the structure that is not recommended by PQC.
29. Second Grade Concrete Products
All second-grade concrete products are non-refundable and are sold at a discount price in a “as is” condition.
PQC are not liable for any further warranty or damage claims on second grade products.
Accounts
30. All goods remain the property of PQC until payment has been made in full. Refer to invoice for payment terms.
